Effective: These Terms & Conditions govern your use of pbcfarm.com and any purchase of live birds from Potts Branch Creek Farm ("we," "us," "our"). By placing an order or checking the "I agree to the Terms & Conditions" box at checkout, you accept these terms.

1. Eligibility

You must be at least 18 years old and legally able to enter into a binding contract to place an order. By checking out, you represent that the information you provide (name, email, phone, address) is accurate and that you are authorized to use the payment method submitted to Stripe.

2. Products

We sell live Rio Grande Wild Turkeys and related products. Birds are subject to availability. Stock counts on the site are kept current but are not guaranteed in real time; if a product becomes unavailable after your order, we will contact you and refund the affected portion of the order.

3. Pricing & Minimum Order

  • Per-bird pricing is shown on each product page.
  • A minimum order quantity applies to each product (typically 10 birds).
  • Volume discounts may apply at higher quantities (e.g., 15 or more birds).
  • Prices are in U.S. dollars and may change at any time, but a confirmed order will be honored at the price you paid.
  • Sales tax, where applicable, will be calculated at checkout.

4. Payment Processing (Stripe)

Payments are processed by Stripe, Inc. We do not store your card number, CVV, or full payment details on our servers. By submitting payment, you also agree to Stripe's terms of service. If your payment is declined or later reversed (chargeback), your order may be cancelled and any reserved birds returned to inventory.

5. Pickup & Delivery

Fulfillment is governed by our Pickup & Delivery Notice, which is incorporated into these Terms by reference. Please review it before placing an order.

6. Refunds, Returns & Biosecurity

All sales of live birds are final once the birds leave the ranch. Cancellations, inspection requirements, and biosecurity rules are governed by our Refund & Biosecurity Policy, which is incorporated into these Terms by reference.

7. Assumption of Risk

Live birds are perishable agricultural goods. Their long-term health and productivity depend on housing, feed, water, predator protection, weather, and other conditions outside our control. By purchasing, you assume all risk of loss after the birds leave our ranch (or are off-loaded at your address for delivery orders).

8. Permits & Legal Compliance

Game bird ownership, transport, and release are regulated in many states. You are solely responsible for obtaining any permits, health certificates, or other documentation required by your state, county, or municipality. We are not responsible for confiscation or fines arising from a buyer's failure to obtain required permits.

9. Account & Acceptable Use

If you create an account, you are responsible for keeping your password confidential and for all activity under your account. You agree not to: misuse the site, submit false information, attempt to interfere with site security, scrape content for resale, or use the site for any illegal purpose.

10. Privacy

Our handling of personal information is described in our Privacy Policy.

11. Limitation of Liability

To the fullest extent permitted by law, our total liability for any claim arising out of or related to a purchase is limited to the amount you paid for the affected order. We are not liable for indirect, incidental, consequential, or punitive damages, including loss of birds after delivery, lost profits, or veterinary expenses.

12. Indemnification

You agree to indemnify and hold us harmless from any claim arising out of your breach of these Terms, your handling of birds after delivery or pickup, or your violation of any applicable law.

13. Changes to These Terms

We may update these Terms from time to time. The version in effect at the time of your order will govern that order. Changes are effective when posted to this page.

14. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in Texas.
